GRIDFIT, a company based in France, provides a software solution enabling remote control systems of electrical equipment to participate in load modulation/demand response in France.
This solution is made available to Users free of charge.
Definitions
Residential demand response (or distributed load shedding): Temporary reduction of electricity consumption across a large number of homes by briefly but coordinately interrupting the power supply to connected devices inside these homes, to reduce the total demand in a region or country without impacting occupant comfort.
Flexibility: The ability of a User to temporarily modulate their electricity consumption.
Markets open to demand response valorization: Mechanisms for electricity consumption and capacity demand response as provided in the French Energy Code (notably Book II, Title VII dedicated to demand response).
Device: All materials required for the User’s remote control of their electricity consumption, intended to enable eventual demand modulation.
Modulation: Temporary modification of the power drawn from the grid by the User’s Site by shifting operating windows of consumption equipment.
Service: The demand response service offered by GRIDFIT, including the platform made available to the client to monitor achieved demand reductions.
User Site: The consumption site for which the User holds the Network Access Contract.
User: Any person meeting the eligibility conditions for the Service and using the Service.
Purpose
These Terms of Use apply to the relationship between GRIDFIT and any User.
GRIDFIT reserves the right to modify these Terms of Use at any time, especially to reflect regulatory or technical changes. Users will be notified of any changes by any means and will have one (1) month from notification to reject the changes in writing, which will terminate the Services. Otherwise, Users are deemed to accept the updated Terms of Use from their effective date.
The Service offered by GRIDFIT
1. General
The User commits to reading these Terms before activating the demand response program to ensure error-free operation.
2. Conditions for access to the solution
2.1 The User authorizes GRIDFIT to enroll their Site in markets open to demand response valorization including the NEBEF mechanism, the Adjustment Mechanism, and System Services. The User also declares not to be engaged with any other Demand Response Operator, Adjustment Actor, Reserve Manager, or via a demand response offer bundled with electricity supply.
2.2 The User authorizes GRIDFIT to control their equipment to perform Modulations and monetize them on the aforementioned mechanisms.
2.3 The User consents to GRIDFIT collecting consumption data and transmitting commercially sensitive or necessary information, including electricity consumption and contractual supply details, to RTE or the Distribution Network Operator.
2.4 The User authorizes RTE to audit the measurement and transmission systems set by GRIDFIT and to verify the demand response activation chain, including during experiments.
2.5 The User agrees to participate in the Capacity Mechanism within certification entities approved by GRIDFIT and acknowledges understanding the associated commitments and responsibilities in the certification contract available on the RTE website.
2.6 The User declares on their honor that performing demand response does not involve the use of fossil fuels.
2.7 The User agrees to participate in the Decarbonized Flexibility Tender with GRIDFIT.
2.8 The User commits to promptly informing GRIDFIT of any move, change of situation, addition of new connected solutions, or malfunctions impacting the Service, by email at contact@tilt-energy.com.
2.9 The User may suspend any Modulation during any period without this constituting contract termination.
2.10 GRIDFIT reserves the right to refuse or terminate membership if eligibility criteria are not met, without any compensation to the User.
2.11 The User waives rights to demand response valorization or related services in favor of GRIDFIT or its partners in exchange for provision of services and device operation.
Liability
The User acknowledges that GRIDFIT has an obligation of means to achieve the objectives of these Terms. However, GRIDFIT does not guarantee:
- Compatibility of equipment with the platform;
- Uninterrupted, error-free availability;
- Specific performance levels or adaptation to User needs;
- Absence of disturbances, hacking, or viruses.
GRIDFIT is only liable for direct damages caused by use of the Service and excludes any indirect damages or third-party claims. GRIDFIT is not liable for failures, suspension, or termination of Service by the connected solution’s pilot service provider.
Duration and Termination
These Terms take effect upon User acceptance and apply indefinitely, with termination possible at any time.
Users may unilaterally terminate without cost by notifying GRIDFIT at contact@tilt-energy.com. Termination is effective one (1) month after receipt of notification. Obligations remain during notice.
For distance or off-premises contracts, Users have a 14-day withdrawal right from the day after contract conclusion, exercisable by notifying GRIDFIT via email including identity details, PDL and Linky meter numbers, and the standard withdrawal form attached to these Terms.
Personal Data
To fulfill the Service, GRIDFIT collects and processes personal data with IT means. Mandatory fields are marked during Web Application use, and Users must ensure data accuracy.
Data collected includes:
- Identification data (name, address, phone, email, PDL, meter number);
- Consumption data and related measurements and actions.
GRIDFIT may access such data to provide consumption monitoring in the Application and Website and verify Modulation activations. Data may be communicated to RTE solely for these purposes.
Data processing purposes include Service provision, consumption control and modulation participation, and Service use analysis/improvement.
Data retention follows legal prescriptions: consumption and command data retained up to 3 years post-aggregation for Service provision, and up to 5 years for contractual and audit purposes with RTE. Data is deleted or anonymized thereafter.
Data recipients include GRIDFIT internal teams, subcontractors, and authorized third parties per legal provisions. Public electricity network operators must maintain strict confidentiality and use data only for network operation, excluding commercial use.
Users have rights to access, rectify, oppose, erase, limit, and port their data per the French Data Protection Act, exercisable at contact@tilt-energy.com.
Users can complain to the CNIL or contact GRIDFIT’s Data Protection Officer at contact@tilt-energy.com.
Intellectual Property
The User acknowledges that all intellectual property rights related to the Services belong to GRIDFIT, whether registered or not. Subscription does not transfer any rights to the User.
All content, including texts, images, infographics, slides, and trademarks related to the Service are GRIDFIT or partners’ property and protected by IP laws.
Any violation constitutes infringement, exposing offenders to civil and criminal penalties.
Governing Law and Jurisdiction
These Terms are governed by French law regardless of use location.
In case of disputes, after attempts at amicable resolution, French courts have exclusive jurisdiction.
Acceptance of Terms and Data Transfer
By accepting, I acknowledge the Terms of Use and the data processing and transfer conditions described under “Personal Data” above.
